Kilmar Armando Abrego Garcia: Can U.S. Deport Citizens?

On March 15, 2025, Kilmar Armando Abrego Garcia was reportedly taken from his Maryland home and deported to El Salvador. The move reportedly took place “with zero proof” behind allegations asserting him as a member of MS-13. Additionally, the decision occurred despite a 2019 court order “explicitly stating he was not to be deported.” Now, the Supreme Court is reportedly fighting for Garcia to be released from detainment and reunited with his family. Furthermore, the jarring mistake has posed a larger concern under the Trump administration: Should the government be allowed to deport citizens they claim are criminals?

Can The U.S. Deport Convicted Citizens?
According to Burns-Tucker, Garcia is a native of El Salvador and reportedly had an open immigration case prior to his deportation. Police have reportedly alleged that Garcia is a member of the MS 13 gang — the gang which has now been deemed a foreign terrorist organization.
Additionally, it has ordered that all members of the gang be deported immediately once identified.
On March 15, Garcia was picked up by ICE agents and told that “his immigration status had changed.” Additionally, in the time that followed the order, the decision was reportedly identified as a mistake by the Trump administration. By April, the Supreme Court reportedly ruled for Garcia to be immediately brought back to the U.S.
However, the Trump administration is not claiming that it won’t be able to do so so quickly.
